On July 29, 2005, CMKM filed a Petition for Review of the Initial Decision and Notice of Appeal of the Administrative Proceeding pursuant to Rule 410 of the Commission's Rules of Practice. CMKM objected to various conclusions of law and findings of fact contained in the Initial Decision of Honorable Brenda P. Murray's.
On August 8, 2005, CMKM was notified by the Office of General Counsel for the Commission of the Order Granting Petition for Review pursuant to Rule 411 of the Commission's Rules of Practice. As stipulated in the order CMKM is required to submit a brief in support of the petition for review by September 6, 2005. A brief in opposition by the SEC's Division of Enforcement must be filed by October 6, 2005 and any reply brief after that must be filed by October 20, 2005.
Additionally, on August 8, 2005, the Division of Enforcement filed a Motion for Summary Affirmance of the Initial Decision requesting the Commission to affirm the Honorable Murray's decision to revoke the registration of the securities of CMKM Diamonds.
A copy of the Petition for Review filed by CMKM is attached as exhibit 99.1 and a copy of the Order Granting Petition for Review is attached as exhibit 99.2.

Info was given to me yesterday that CMKX and the last hold out short
came to a final agreement. It sounds like attys need to draw up final
paperwork or it could have been in a form already. I do beleive what I
was told.
Yes I am excited but I have to maintain a calmness until I see
something from the company confiming what was said to me yesterday. So
lets all relax and patiently wait. This is what we have waited over a
year to hear and hopefully the next two weeks will be exciting.

For the last year I have held CMKX stock patiently waiting for that
big event to take place. I am feeling more confident at this time
then I ever have. In my opinion rewards are coming for shareholders.
Guys and gals we are the miners of the Twenty First Century. We are
a different style of miner because we have a vehicle to invest called
the stock market. The stock market is our tool to mine start-up
companies to find our fortune. I believe or fortune is close and
coming soon.
I would start to watch for significant events to start unfolding in
regards to your CMKX investment.
On another subject "Frizzell Meeting With Select Shareholders". I am
appalled that Frizzell would share sensitive information with a
select few shareholders. Frizzell had a meeting in Texas about two
weeks ago presenting very negative information about Urban and the
company. I was told information came from the SEC in the form of 700
documented pages. I am appalled that supporters of CMKX would fall
into the severe negativism that was presented in that meeting.
On arrival home the phones started ringing at negative information
was shared with many. Sterling's room at PalTalk was a center of
this negative information. The leaders of many tuned on Urban after
the Frizzell presentation rushing to share this one-sided information
further Frizzell's cause. What was Frizzell's cause? He surely
wasn't supporting Urban or loyal shareholders backing Urban's
lifetime work claiming claims and building a company that will
leading shareholders into one of the biggest mining conglomerates
history will experience.
I watch Topo turn his back on Urban after being at Urban's side. I
watched Sterling's leaders believe what was told to them. I watched
Dr.D question Urban. I watched Hugo question Urban. I was appalled
that these individuals would question Urban or their own decisions of
the choice of investment.
Frizzell had Hugo present taping his presentation in Texas two weeks
ago. I guess Frizzell wanted to make a big part in Hugo's
documentary as the saving lawyer that saved shareholders. I have a
hard time with that entire fiasco that took place and the intentions
present at the meeting.
Hal Engel aka WillyWizard stands 100% behind Urban Casavant and CMKX.
I stand firmly in my convictions that I made the right choice
investing in Urban's company and Urban's dream. I want all
shareholders to know I am one of the only so-called leadrers that
hasn't budged since that uncalled for meeting by Frizzell. No one-
sided documentation would make me waver to turn on Urban.
Recently rumors are spreading via WillyWizard's Paltalk room
entitled "WillyWizasUnderGround" that the short situation has been
stopped. We all hope Urban and Bob Maheu forced a deal with the
shorts to stop hurting shareholders investment value. I personally
believe this has taken place and look forward to see the end result.
I am the only leader of many that believes talks of a settlement have
been on-going and could have recently ended with a positive outcome
for shareholders of CMKX. Call me crazy if you want to but again I
stand behind my conviction that a settlement is what Urban has been
working towards for the last year.
Members and all readers hold those shares and pray for the leaders of
CMKX. Don't waver or turn your back on CMKX like many recently did.
Even those that turned their backs will soon see Willy Wizard is
right and Hugo will finish Urban's documentary in a positive manner.
Watch for news from CMKX in the near future.

إخترْ بِضْعَة حَمَلةَ أسهم. Frizzell قابلَ في تكساس حوالي إثنان
تَقديم قبل أسابيع المعلومات السلبية جداً حول حضريةِ و
الشركة. أنا أُخبرتُ معلوماتَ جاءتْ مِنْ إس إي سي على شكل 700
الصفحات الموثّقة. أَنا مُرَوَّعُ بأنَّ مؤيدو سي إم كْي إكس أَسْقطُ
إلى negativism الحادّ الذي قُدّمَ في ذلك الإجتماع.
على بيتِ الوصولِ، بَدأَ الهواتفُ بالدَقّ في المعلوماتِ السلبيةِ
إشتركَ مع الكثيرِ. غرفة الإستيرليني في PalTalk كَانتْ a مركز
هذه المعلوماتِ السلبيةِ. زعماء الكثيرِ نغّموا على حضريِ بعد
تقديم Frizzell يُسرعُ للإشتِراك في هذه المعلوماتِ الأحادية الجانبِ

إعتقدْ هذا حُدِثَ ويَتطلّعَ لرُؤية النتيجة النهائيةِ.

يبدو أن لوائح الفجر قد لاحت على السهم هذه المرة وهذا الرجل يملك لوحده قرابة المليار سهم منذ سنة. على هذا لو نجحت العملية سيكون إمبراطورية داخل أمريكا ويسميها على اسمه
أود أن أسالك سؤالا أخي السبيعي عن ما تداول في المحكمة الأخيرة علما أن الإجتماع الذي تم قبل ذلك إتهمت فيه الهيئة SEC اعضاء الشركة بالتلاعب بميزانيتها ووثائقها ويبدو أن الإتهام قد وجه للسيد فريتزل في المحكمة.
وهل كان عدد 7000 مستثمر من 52000 الذين قدموا إثباتات للمحامي فريتزل كافيا لبلوغ النصاب وإثبات الشورت ؟؟.
ومع تفاؤلي الشديد إلا أن مسالة تغطية الشورت هذه تحيرني كثيرا إذ أن القيمة تدخل في أرقام هلاوسية
فإلى الآن وحسب موقع البنك شيت يصل عدد الأسهم العائمة 700مليار. علما أن هذا الرقم جدا متواضع مع الرقم الهلاوسي الحقيقي للشورت.
والظاهر للعيان أن السهم لن يرتفع بشكل تدريجي بل سيكون على شكل قفزات

I hope this is my last alert on CMKX before payday. Yes I mean payday. We have been expecting a settlement concerning naked shorting of CMKX shares. As shareholders this naked shorting has hurt our shareholder value which in my mind is an increase in share price according to value within the company. I understand it’s tough to determine shareholder value when CMKX has not shown the value of the company. I think this is all going to change in October. (Just My Opinion)
For the last year and a half I have been sending CMKX out as a stock I have put a considerable amount of money in. It’s always been my policy to present to club members stock I own. I have always maintained if I don’t own the stock why should you. Understand I send out a lot of stocks I don’t own this doesn’t mean I recommend the stock because I don’t own it. When I put my money where my commentary is then we should all watch what I am doing. This was the case of CMKX last year when I started accumulating a position.
CMKX has two basic plays at this time, one being the legal play because of naked shorting and the second the value play because of assets. This gives shareholders two opportunities to realize a profit and the profit could be significant within both plays.
The legal play is the first play that has to take place but this doesn’t mean the value play isn’t taking place it just means CMKX needs to take care of the naked short problem before they can start announcing the value part of the company or what has actually taken place within the last 16 months since the club started accumulating a position.
Rumor has it a couple trillion shares of CMKX have been sold in the market, a share count that is beyond many readers comprehension. Yes everyone this could happen and in my opinion it did. This took place because Market Makers who facilitate the order flow from your brokerage houses sold shares they didn’t have in possession. Rumor has it these entities that created the legal play have all settled with the company. If this is true we could hear about this as early as this coming week, October 3-7 trading week. This would be great if this were to take place. Members we have waited a long time for this club stock play to give us a payday. I can honestly write to you and say in my opinion it’s payday this month.
Now we need to look at what value the company has at this time.
1. Diamond Kimberlites: These are flumes coming up from the center of the earth long ago which contain diamonds. It’s known to shareholders the company has done a lot of development in locating these diamond kimberlites in Canada. This alone could bring the company a hue valuation upwards to a آ½ trillion dollars or more.
2. Gold: The company has a gold mine in operation in Ecuador called the American Mine. This mine is producing at this time but it’s unknown to shareholders what production is at this time. Also gold claims in Canada and joint ventures in Canada and United States should be taken into account for valuation. This valuation could be well into the billions accumulative.
3. Uranium: Recently a news release was put out by a Joint Venture partner addressing 40% ownership in Uranium claims in Canada. It is well know Uranium is a priceless commodity with world countries seeking it for Nuclear Power Plants. The value of this JV, even at 40%, could head well into the billions.
4. Oil: Oil Sands are the topic of discussion on TV and in many news letters that are out in circulation. CNBC has recently addressed oil sands in Canada and a news letter I receive entitled Hidden Wealth has been writing about oil sands as a hidden play for their investors. None of the entities have mentioned CMKX in their commentaries or if they have it’s been quietly mentioned.
Oil is big business world wide and the United States citizen is starting to find out how big of business oil really is as our fuel prices have headed above $3.00 per gallon over the last 6 months.
How do we value oil within CMKX….It’s tough but if rumors are remotely close CMKX has claims which are huge in the oil sands arena. I would guess this figure could run as high as a Trillion dollars or higher.
5. Other Minerals: I would guess along with Diamonds, Gold, Uranium and Oil CMKX has found other valuable minerals. I’ll not even guess a value at this time.
Club members hang in there because time is money in our stock accounts. I believe time is rewarding us with increased valuation within our portfolios and many don’t even understand this. Many think CMKX is a joke and have sold. Those that have sold will be very upset if and when CMKX starts announcing the legal play settlement figures we as shareholders will receive. Ad in valuation and the stock price should move much higher, what a play CMKX could turn into over the next 10 years as new and old discoveries are announced to the investment world.
Yes everyone you have read my commentaries about CMKX for a long time, very bullish in my writing. I have not wavered on this investment and I am as excited today as I was when I first bought shares over a year ago.
Members YOU ARE the miners of the Century. WE are so lucky we can do exploration via a publicly traded company that is exploring for us. We can set in the comfort of our homes, cozy and warm, while others do the hard work. Hold the faith everyone because rewards are about to come to us.(in my opinion).
One more thing….don’t believe the bad rumors that have been spread from the Owners Group. These rumors and the ones spreading them have no clue about what is really taking place inside CMKX. These rumors are grossly exaggerated. The rumor spreaders are disgruntled shareholders that have been detached from any information from CMKX and now they have wavered and are lost. When they received info they were heroes and now they are unhappy lost shareholders that want others to join in their pity party. Please WillyWizard Club and WillyWizardsUnderGround members stay clear of the pity party shareholders that are spreading these rumors. Our Yahoo Club and our PlaTalk room, WillyWizardsUnderGround, are safe places you can go to that do not promote negativity and I (we) will not allow this cancer to enter into play in these rooms.

Also gold claims in Canada and joint ventures in Canada and United States should be taken into account for valuation. This valuation could be well into the billions accumulative.
3. Uranium: Recently a news release was put out by a Joint Venture partner addressing 40% ownership in Uranium claims in Canada. It is well know Uranium is a priceless commodity with world countries seeking it for Nuclear Power Plants. The value of this JV, even at 40%, could head well into the billions.
4. Oil: Oil Sands are the topic of discussion on TV and in many news letters that are out in circulation. CNBC has recently addressed oil sands in Canada and a news letter I receive entitled Hidden Wealth has been writing about oil sands as a hidden play for their investors. None of the entities have mentioned CMKX in their commentaries or if they have it’s been quietly mentioned.
Oil is big business world wide and the United States citizen is starting to find out how big of business oil really is as our fuel prices have headed above $3.00 per gallon over the last 6 months.
How do we value oil within CMKX….It’s tough but if rumors are remotely close CMKX has claims which are huge in the oil sands arena. I would guess this figure could run as high as a Trillion dollars or higher.
5. Other Minerals: I would guess along with Diamonds, Gold, Uranium and Oil CMKX has found other valuable minerals. I’ll not even guess a value at this time.
Club members hang in there because time is money in our stock accounts. I believe time is rewarding us with increased valuation within our portfolios and many don’t even understand this. Many think CMKX is a joke and have sold. Those that have sold will be very upset if and when CMKX starts announcing the legal play settlement figures we as shareholders will receive. Ad in valuation and the stock price should move much higher, what a play CMKX could turn into over the next 10 years as new and old discoveries are announced to the investment world.
Yes everyone you have read my commentaries about CMKX for a long time, very bullish in my writing. I have not wavered on this investment and I am as excited today as I was when I first bought shares over a year ago.

We can set in the comfort of our homes, cozy and warm, while others do the hard work. Hold the faith everyone because rewards are about to come to us.(in my opinion).
One more thing….don’t believe the bad rumors that have been spread from the Owners Group. These rumors and the ones spreading them have no clue about what is really taking place inside CMKX. These rumors are grossly exaggerated. The rumor spreaders are disgruntled shareholders that have been detached from any information from CMKX and now they have wavered and are lost. When they received info they were heroes and now they are unhappy lost shareholders that want others to join in their pity party. Please WillyWizard Club and WillyWizardsUnderGround members stay clear of the pity party shareholders that are spreading these rumors.
